Terms and Conditions for Online Freelancer Marketplace
These Terms and Conditions (“Terms”) govern your use of mastered. By Front Porch Music (the “Platform”), operated by Front Porch Music + Marketing (“Company”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1. User Accounts
1.1 You must be at least legal working age to use the Platform. Legal working age is based on the province or state in which you reside.
1.2 You agree to provide accurate and complete information when creating an account on the Platform. This includes your full legal name or legal business name, billing address, and contact information.
1.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Services
2.1 The Platform connects freelancers (“Freelancers” or “Masters”) with individuals or entities seeking services (“Clients”).
2.2 Freelancers agree to provide services to Clients in accordance with mutually agreed-upon terms, including scope, deadlines, and compensation.
2.3 The Company does not guarantee the quality, accuracy, or legality of services provided by Freelancers, nor does it guarantee the performance of Clients.
2.4 The minimum value a service may be listed at is $15 CAD. Listings that are posted at less than $15 CAD will not be approved.
3. Payments
3.1 Payments for services rendered are pre-determined through direct purchase of services established prior to purchase. The price of services are advertised in a freelancer’s ad.
3.2 The Company may facilitate payments through third-party payment processors. By using such services, you agree to abide by their terms and conditions.
3.3 Company may charge fees for the use of the Platform, which will be clearly outlined and agreed upon before any transactions occur. Fees are listed in invoices and are viewable prior to purchase.
3.4 Refunds can be requested by the Freelancer or the Client. If a Freelancer rejects an order, it will be refunded to the Client. If a Client no longer wishes to have the Freelancer’s work done, they can request a refund within 3 days of purchase. Refunds may take up to 14 days to process.
3.5 Freelancers are responsible for payment of any taxes, including any GST, or income tax, which may apply to them depending on residency, location or otherwise, under provisions of their jurisdiction. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction.
4. Content
4.1 All Users of the Platform are solely responsible for the content they post on the platform, including profiles, services, and communications.
4.2 All Users agree not to post content that is false, misleading, defamatory, or infringes upon the rights of others.
4.3 The Company reserves the right to remove any content that violates these Terms or is otherwise deemed inappropriate.
5. Disputes
5.1 The Company is not responsible for disputes between Freelancers and Clients. However, we may provide dispute resolution services at our discretion.
5.2 Users agree to attempt to resolve any disputes between themselves in good faith before seeking assistance from the Company.
6. Termination
6.1 Company reserves the right to suspend or terminate your account at any time for violations of these Terms or for any other reason, with or without notice.
6.2 Upon termination, all rights and licenses granted to you under these Terms will immediately cease. Any outstanding payments will be paid out within 14 business days.
7. Disclaimer of Warranties
7.1 The Platform is provided on an “as is” and “as available” basis. The Company makes no warranties, express or implied, regarding the Platform’s reliability, accuracy, or suitability for any purpose.
8. Limitation of Liability
8.1 In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.
9. Governing Law
9.1 These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflict of law provisions.
10. Changes to Terms
10.1 The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
